Factory Order Selector Pleads Guilty to Workers Compensation Insurance Fraud


On December 17th, 2018 the Special Investigative Unit of RJN Investigations was notified by the Los Angeles District Attorney’s Office as to the successful prosecution in the case of People of California v. C. Santiago. In this case, the claimant alleged a work-related injury to both knees. Despite medical treatment for over a year, the claimant stated he could still barely walk and could not work modified duty. A subsequent surveillance level investigation by the RJN SIU found the claimant to be engaged in outside physical activities that directly contradicted his statements to the treating Doctors. Given these material representations and in accordance with the regulations set forth by the California Department of Insurance, the case was then filed with their Fraud Division and with the Los Angeles County District Attorney’s Office. Upon conclusion of the criminal investigation, the claimant was then arrested and formally charged with two felony counts in violation of Insurance Code 1871.4(a) (1). Initially, the claimant would not accept a plea bargain agreement and as such the sub-rosa investigators testified before the Superior Court Judge. The sub-rosa video evidence was then entered into evidence. After several additional hearings, the claimant changed his plea to guilty. On December 17th, 2018, he was sentenced to time served plus 24 months of formal probation. His restitution hearing has yet to be scheduled.




Formed in 1996, the SIU Division was created to assist California employers, small size insurance carriers and TPA firms in securing professional assistance so as to detect, investigate and prosecute insurance fraud. To date, the unit has trained well over 2,750 examiners and the documented referrals by this unit have resulted in over 185 convictions for workers’ compensation insurance fraud in California.
