Los Angeles County Secures Felony Conviction


 On November 6th, 2018 the Special Investigative Unit of RJN Investigations was notified by the Los Angeles County District Attorney’s Office regarding the successful prosecution in the case of the People of the State of California Vs. Perez. In this case, The RJN SIU secured substantial video evidence of the claimant displaying no hesitations as the claimant was seen completing day to day tasks. This display was a complete contrast to what the claimant alleged during medical treatments as well as during the deposition testimony.  Surveillance video was provided to the treating doctor who in turn indicated the following, “In all of the films the claimant walks in a normal fashion with long strides, carries no cane or crutch for support, and appears to be in no discomfort.  The films clearly discredit the statements as to the degree of impairment that the claimant has.”  RJN SIU formally referred the case to the Los Angeles County District Attorney’s Office as well as the California Department of Insurance Fraud Division. Upon completion of their criminal investigation, the claimant was arrested and formally charged with one count of Insurance Code 1871.4(A)(1). The claimant posted bail of $30,000.00 and entered a not guilty Plea during the arraignment. On November 1st, 2018 the claimant changed her plea to “no contest” to count 1. She was then ordered to perform 200 hours of community service and to pay restitution to the California Department of Social Services I.H.S.S. in the amount of $90,274.67.   


Formed in 1996, the SIU Division was created to assist California employers, small size insurance carriers and TPA firms in securing professional assistance so as to detect, investigate and prosecute insurance fraud. To date, the unit has trained well over 2,750 examiners and the documented referrals by this unit have resulted in over 185 convictions for workers’ compensation insurance fraud in California.
