Truck Driver for Robertson’s Ready Mix Convicted of Fraud and Ordered to Pay $26,012.97 In Restitution

On December 27th, 2018 the Special Investigative Unit of RJN Investigations, Inc. was formally notified by the Riverside County District Attorney’s Office regarding the successful prosecution in the case of People of California vs. A. Alcantar. In this particular case, the claimant worked as a Cement Truck Driver who filed a claim alleging to have sustained injuries to his left ankle. A surveillance level investigation performed found the claimant active at Knots Berry Farm walking without the aid of a cane or wheelchair. When questioned during a subsequent deposition, the claimant admitted to traveling to the amusement park, however indicated that he utilized a wheelchair the entire time and also did not ride any of the rides which was a material misrepresentation based on the surveillance obtained. The claimant was subsequently arrested based on a formal fraud referral completed by RJN Investigations and notified of three felony counts that were filed against him. Initially, the claimant plead not guilty to all counts, however after being presented with the evidence against him, he agreed to a plea agreement in which he would change his plea on one felony count to guilty (IC 1871.4 – Filing a false workers compensation claim) and the remaining 2 counts would be dismissed. On December 17th, the claimant was formally sentenced to 30 days of custody at Riverside Sheriff’s department (26 days to be served in work release program/community service), 36 months of probation, and ordered to pay back Robertson’s Ready Mix $26,012.97 in restitution.
